US DEBT CEILING Debate: What Is It?

WHAT IS THE DEBT CEILING?

The United States public debt limit stands at US$14.3 trillion dollars. This was an increase from US$12.394 trillion by the Democratically-controlled Congress on 12 February 2010. This US$14.3 trillion represents the most amount of money that the Unites States government can borrow without receiving additional authorisation from the Congress. Under US law, when the national debt reaches a certain limit or ceiling, the Congress must authorise the raising of the debt to a higher limit in order for the government to continue to borrow more money. The United States’ actual accrued debt exceeded the US$14.3 trillion mark in May 2011. The current debt as of 27 July 2011 is US14,349,973,387.96. 

The United States Department of the Treasury (equivalent to a Ministry of Finance) is authorised by Congress to issue such debt as is needed to fund government operations (per each federal budget) as long as the total debt does not exceed the statutory ceiling. Since 1979, the House of Representatives without debate has automatically raised the debt ceiling when passing a budget, except when the House votes to waive or repeal this rule. During the profligate military spending of the Reagan administration 1981-1988, the debt ceiling was raised 18 times. George W. Bush raised the debt ceiling seven times in order to fight against peoples of Afghanistan and Iraq. Article I Section 8 of the United States Constitution gives the Congress the sole power to borrow money on the credit of the United States. More importantly, the 14th amendment of the US Constitution states simply that, ‘The validity of the public debt of the United States…..shall not be questioned.’ 

The Obama administration wants to raise the debt ceiling to US$16 trillion. When the US economy went into a recession in 2008, as a result of the financial crisis on Wall Street and the subsequent bailout it received, President Obama attempted to assist the real economy by increasing fiscal spending to help maintain levels of domestic demand. These acts coupled with formal inclusion (in the budget) of the US$10 billion per month that the US government is spending on two wars have increased the debt. These expenditures along with the maintenance of the tax cuts enacted by President Bush are the primary reasons why President Obama’s administration has sought an increase in the debt ceiling. However, for the first time in decades the conservative forces of the US are using this debt ceiling debate to create a false sense of fiscal crisis and thus, use the false fiscal crisis to pursue their desire to force greater cuts to Social Security, Medicare and Medicaid. These are entitlement programmes for the majority of the population, particular for the poor and elderly.

Working with Tim Geithner, the Secretary of the Treasury, the government gave 2 August 2011 as the deadline to raise the ceiling, or otherwise the government, would not be able to pay its bills. While other options do exist (such as the president invoking the 14th Amendment to the Constitution), this doomsday scenario reflects how elements in the Democratic Party are also fuelling a false sense of crisis. Meanwhile all around the world this debate is awakening billions of people to the reality of the present state of the US economy. Thanks to this debate, the world is now discovering what the US economy is really about; not what they imagined it.

This false crisis serves to conceal the real issue: That the debt ceiling debate is really another gambit to step up class warfare against the majority of American citizens and the planet by the growing political power of the top one per cent of US society. Raising the debt ceiling has never been contingent on the cutting of social safety nets for the poor and elderly while the rich enjoy tax breaks, corporate welfare and subsidies. Neither has it been on the condition of ending funding for the kind of public investments needed to transform the outdated economic arrangements. The debt ceiling is about paying for spending already approved by previous congresses and presidents. 

Wall Street and the bond rating agencies are threatening to downgrade the US triple AAA rating – should the US default on its debt – in order to pressure a deal between the Republicans and the Obama Whitehouse. Republicans want deep cuts in entitlement programmes for the poor, elderly and infirm, and everyone is talking about depressions and recessions, while the masters of the universe (the Wall Street barons) are doing just fine.

The debt ceiling debate is manufacturing a phony crisis because the question of the trillion dollar military budget is not being vigorously discussed. More importantly, the deficits increased because of the collapse of the housing bubble and the massive sums expended to rescue the financial institutions. The population needed to be educated on the scams of the banks and their responsibility for this economic crisis. Additionally, there is no serious discussion of having the incomes of billionaires taxed at the same rates as the wages of workers, just as are no talks about breaking up the banking and derivatives cartels. In order to suggest that the Democratic Party is considering an imposition of taxes on those who earn more than US$250,000, President Obama has been mentioning this figure in press conferences and in the media but there has been no serious effort to generate a comprehensive analysis and programmes to educate the working people on the need to tax the rich. A three per cent financial transaction tax (FTT) on America’s wealthy derivatives dealers in the US$600 trillion industry will go a long way to making a dent in the budget deficit. By focusing on re-election, the Obama administration seems to have no leverage or control, and is moving so far to the right that the poor are suffering even more. The progressive left must organise to set the agenda by educating the people on the dangers of wars and more militarism to save the rich.

CLASS WARFARE AND CONSERVATISM

In a normal economy, a country that is as indebted as the United States must find ways to balance its books and pay its debts. The rules that were established by the IMF that countries should live within their means do not apply to the United States because as the super power, its debt is denominated in dollars and the US can print its currency at will. This was not the original policy. Under Article 9 of the Agreement of the International Monetary Fund (IMF), the US is supposed to back up its currency with gold. 

However, since 1971, the US dollar is supported by their military. Most countries keep their reserves in dollars so that the US can run up a huge debt, with the consequence of devaluing the hard-earned reserves of those countries with US dollar reserves. The Europeans attempted to get out of this domination of the dollar by establishing the euro. Presently, the US holds about 64 per cent of the international reserves and the Europeans hold about 20 per cent. In the past three years as the capitalist crisis deepened all over the world, European workers have been struggling against so-called austerity measures taken by their governments. These measures are imposed on working peoples so that banks and other speculators do not have to take the financial losses they have incurred. The public discussion of the Greek crisis and the attempts to salvage the situation has placed great strains on the euro. There are some in the US who would like the Euro to collapse, because its very existence threatens the status of the dollar as the international reserve currency. 

However, just when the class struggle was getting hotter in Europe with workers marching onto the streets of Athens, Dublin and Madrid, the Chinese President Hu Jintao announced at the end of June that China would increase its support of the euro. The Chinese President pledged to spend billions of whatever it took to prop up the single currency: the euro, just as it is simultaneously propping up the dollar. With this assurance, on Thursday 21 July 2011, the leaders of the European Union announced a rescue plan to save the Greek economy. The real rescue here was that global capital (especially the French and German bankers), backed up by Chinese capitalists, who stepped in to ensure that capitalism would remain powerful as a force against the working class. The Chinese government holds US$1.8 trillion of the US debt and is a major creditor for the US capitalist classes.

THE BANKERS AND THEIR POLITICIANS

Because capital is global, the capitalists do not have loyalty to any one society. Through offshore banks and computer-generated movement of funds, these capitalists operate beyond the laws of governments. Prior to the present era of neoliberal globalisation, one could speak of national capitalists, but today, capital has only one loyalty: To save the system, regardless of the costs to humanity in famine, hunger, wars or destruction of the environment. 

The outrage caused by the bank and mortgage fraud in 2008 had temporarily placed the bankers and hedge fund managers on the defensive. This was the period when the government had to bail them out and transferred over US$14 trillion to them. In this political climate, the Senate passed the Dodd-Frank amendment aimed at regulating the financial services industry.

The financial crisis of 2007–2010 that destroyed major securities firms, froze credit markets and eliminated US$26.4 trillion in stock market value around the globe led to widespread calls for changes to the financial regulatory system. In June 2009, President Obama introduced a proposal for a ‘sweeping overhaul of the United States financial regulatory system in 75 years.’ The subsequent law, The Dodd–Frank Wall Street Reform and Consumer Protection Act, was signed into law by President Barack Obama on 21 July 2010. 

Under this law, there was to be government oversight through:

1. The consolidation of regulatory agencies, elimination of the national thrift charter, and new oversight council to evaluate systemic risk
2. Comprehensive regulation of financial markets, including increased transparency of derivatives (bringing them onto exchanges)
3. Consumer protection reforms including a new consumer protection agency and uniform standards for ‘plain vanilla’ products as well as strengthened investor protection;
4. Tools for financial crises, including a ‘resolution regime’ complementing the existing Federal Deposit Insurance Corporation (FDIC) authority to allow for orderly winding down of bankrupt firms, and including a proposal that the Federal Reserve (the ‘Fed’) receive authorisation from the Treasury for extensions of credit in ‘unusual or exigent circumstances’
5. Various measures aimed at increasing international standards and cooperation, including in this section were proposals related to improved accounting and tightened regulation of credit rating agencies.

These stipulations were not yet signed when the bankers went into overdrive and spent millions on lobbyists to undermine and whittle away the legislation. The bankers regrouped and supported the most conservative sections of the US society, and ensured the victory of nearly 100 new conservative members of Congress in November 2010, with the majority propped up by the Tea Party. Republican Senator Mitch McConnell stated that the number one task of the new Congress was to ensure that Barack Obama was not re-elected. 

The much publicised crisis about the debt ceiling championed by the Republican law makers is not just a tool to deepen the economic crisis with the aim of dashing Obama’s re-election bid. By using as bargaining chips in the debt ceiling debate corporate welfare, tax protection for Wall Street and the wealthy, many of the Republican law makers have given the American people no reason to doubt that they are errand men and women for bankers and corporations. It was these same Republican law-makers who frustrated Obama’s appointment of Elizabeth Warren as head of the US Consumer Financial Protection Bureau (CFPB). The fact that Warren’s credentials presented her as someone who would be tough on the criminal activities of banks that prey on American consumers made the Republican lawmakers block her confirmation for the job. 

THE TIMIDITY OF OBAMA

Obama has refused to lead and expose the criminal activities of the banks. During the Savings and Loans Crisis of the 1990s, hundreds of bankers were arrested, but in the aftermath of the 2008 collapse, only Bernard Madoff and a few underlings were sent to jail. The banks had been involved in massive fraud but they operate as a law unto themselves. The Justice Department under Obama continued the traditions of the Clinton administration – being deferential to the banks and agreeing that the banks could police themselves for fraud. With the intense campaigning by the banks against the Dodd-Frank legislation, the Obama administration has now retreated on most of the provisions of the Dodd-Frank legislation. Obama sent a signal of his surrender to Wall Street when he nominated former Ohio Attorney General Richard Cordray as the head of CFPB instead of Elizabeth Warren, who served as Assistant to the President and Special Advisor to the Secretary of the Treasury for the Consumer Financial Protection Bureau. The central mission of the CFPB, which resulted from the Dodd-Frank act and began operation on 21 July 2011, is to make markets for consumer financial products and services work for Americans – whether they were applying for a mortgage, choosing among credit cards, or using any number of other consumer financial products. Warren had worked hard for the establishment of this agency to oversee the banks. 

Earlier, after Obama gave in to the opposition from the conservative lawmakers opposed to true financial reform in Congress, in order to make sure that Wall Street received the message that he is not their enemy, Obama appointed William Daley as his chief of staff. Daley came directly from J. P. Morgan Chase & Co, where he worked closely with JPM Chase’s chief executive officer, Jamie Dimon, who is competing to be known as the number one banker internationally.

Obama then appointed the CEO of General Electric, Jeffrey Immelt, to lead a new White House panel, The President’s Economic Recovery Advisory Board, to advise the government on how to help American companies create more jobs. The New York Times, on January 21, 2011 had the headline ‘Obama Sends Pro-Business Signal With Adviser Choice.’ This appointment by Obama was a direct slap in the face of the working class because GE had become central to the financial services industry and received a bailout. GE also admitted that it did not pay any federal corporate taxes in recent years, outsourced jobs overseas and become a leading supporter of policies enabling the growth of speculative markets internationally. The appointment of Immelt was the clearest sign of Obama’s capitulation to the masters of the universe. A clear position on new jobs for a post-industrial society must come from the progressive sections of society because Obama and his advisers have shown that the conditions of the majority is not their primary focus. 

BRINKMANSHIP AND CLASS WARFARE

Before the July 22 deadline, the various Democratic Party plans could be summed up as follows: 

Cut US$2.7 trillion in federal spending and raise the debt limit by US$2.4 trillion in one step – enough borrowing authority to meet Obama's bottom-line demand. The cuts include US$1.2 trillion from across a range of hundreds of government programs and US$1 trillion in savings assumed to derive from the end of the wars in Afghanistan and Iraq.

There was very little difference between the Democratic plan and that of the Republicans. The major difference was that instead of raising the debt limit by US$2.4 trillion in one go, the Republicans wanted the limit for US$1.2 trillion for six months, and requiring that in another six months (in the middle of the Presidential campaign) Obama and the Democrats would to go back to the Congress for another long drawn out debate on the debt limit.

On Monday night, 25 July 2011 three days after Geithner sent the warning of the need for a Congressional vote, President Barack Obama addressed the US public to alert them to the state of the negotiations. 

In his 15 minute speech outlining the dividing lines between the Republicans and the Democrats, he said, ‘The first approach says, let's live within our means by making serious, historic cuts in government spending. Let's cut domestic spending to the lowest level it’s been since Dwight Eisenhower was president. Let's cut defense spending at the Pentagon by hundreds of billions of dollars. Let's cut out waste and fraud in health care programs like Medicare. And at the same time, let's make modest adjustments so that Medicare is still there for future generations. Finally, let's ask the wealthiest Americans and biggest corporations to give up some of their breaks in the tax code and special deductions.’ 

All the scare talk about the government not being able to send out social security cheques if there was no deal was being promoted in the media despite the reality that social security is in the black and not in the red. The question of the social security cheques going out was not the real issue. The real issue was the fact that Obama and the leaders of the Senate had conceded on all of the points of the Republicans (cutting entitlement programmes), if they agreed to the debt ceiling extension and postpone the debate until after 2012. 

In short, there has been a postponement of the real discussions on alternatives: Cutting the military budget, arresting the fraudsters of Wall Street and taxing the rich.

Obama again failed to lead and was instead begging.

But by this time, the begging was too late. The charade and theatre of the US debt ceiling debate had reached every nook and cranny of the globe. Citizens all over the world were now paying attention and were not waiting for the bond rating agencies to make decisions about their future relationship to the US dollar. 

The Republican Speaker, John Boehner, emboldened by the timidity of Obama rejected compromise and requested prime time billing, the same as that received by the President of the United States. The corporate media obliged and the Speaker reiterated the Ayn Rand platform of the Tea Party forces with the same old budget proposals. The Republicans called their plan,’cut, cap and balance.’

Robert Greenstein, President, Center on Budget and Policy Priorities said that the proposal of Boehner was an extension of class warfare because House Speaker Boehner’s New Budget Proposal ‘would require deep cuts in the years immediately ahead in Social Security and Medicare benefits for current retirees, the repeal of health reform’s coverage expansions, or wholesale evisceration of basic assistance programs for vulnerable Americans.’ 

Greenstein added that:

‘To secure US$1.5 trillion in entitlement savings over the next ten years would require draconian policy changes. Policymakers would essentially have three choices: 1) cut Social Security and Medicare benefits heavily for current retirees, something that all budget plans from both parties (including House Budget Committee Chairman Paul Ryan's plan) have ruled out; 2) repeal the Affordable Care Act's coverage expansions while retaining its measures that cut Medicare payments and raise tax revenues, even though Republicans seek to repeal many of those measures as well; or 3) eviscerate the safety net for low-income children, parents, senior citizens, and people with disabilities. There is no other plausible way to get US$1.5 trillion in entitlement cuts in the next ten years.’

The Boehner plan contains no tax increases. The entire US$1.8 trillion would come from budget cuts.

Meanwhile the dithering and brinksmanship continued without a real discussion of alternatives. Serious economists such as Michael Hudson and Paul Krugman dismissed the games that were being played and said that there would be a deal. The debt ceiling would be raised one way or another.

For the working people, the question was how much the deal would intensify their pain. Instead of openly saying that the role of government is to defend the rich, there is the language of austerity. This calls for the rolling back of the social democratic gains of the working peoples since 1935 FDR legislative era, with the cutting back of Medicare, Medicaid, and Social Security. Internationally and locally, capital is forcing down wages. Today in the United States there is an attack on collective bargaining and an outright effort to destroy trade unions. The capitalists are outsourcing jobs (which results in a labour surplus and lower wages), and driving up the prices of food and energy by depreciating the dollar.

 kwa maslahi ya umma wa Watanzania, napenda kuchukua nafasi hii kumshukuru Mwenyezi Mungu kwa kuniwezesha kuwepo hapa leo, kuwasilisha Maoni na Mapendekezo ya Kambi rasmi ya Upinzani, kuhusu Wizara ya Mambo ya Ndani, kwa mujibu wa kanuni ya 99(7) ya Kanuni za Kudumu za Bunge, Toleo la mwaka 2007.

Mheshimiwa Spika, 
natoa pia shukurani zangu za dhati kwa familia yangu, Mke wangu Neema Lema, watoto wangu, Allbless Lema na Brilliant Lema, na wazazi wangu wote, Mzee Elibariki Jonathan Lema na Mama .

Mheshimiwa Spika, napenda pia kutoa shukrani zangu za dhati kwa wapiga kura wangu wa Jimbo la Arusha Mjini kwa imani yao kwangu. Licha ya vitisho, vipigo na mabomu ya machozi yaliyotawala kampeni na hata siku ya kupiga, kuhesabu kura na kutangaza matokeo, wananchi wa Arusha waliendeleza msimamo wao wa kutetea haki kwa kulinda kura zao kwa ujasiri wa hali ya juu. Kwa ujasiri wao, kwa uvumilivu wao, na kwa kujitolea kwao, wananchi hawa wameendelea kutukumbusha kuwa: “Ni heri ya vita inayotafuta haki na usawa kuliko amani inayopumbaza na kudhalilisha utu wa mwanadamu.”

Mheshimiwa Spika, ninapenda pia kumshukuru Kiongozi wa Kambi Rasmi ya Upinzani Bungeni, Mhe. Freeman Aikaeli Mbowe, Naibu wake Mhe. Kabwe Zuberi Zitto, na Mnadhimu Mkuu Mhe. Tundu Antiphas Mughwai Lissu, kwa kutambua uwezo wangu na kunipa dhamana ya kuwa Waziri Kivuli wa Wizara hii nyeti ya Mambo ya Ndani

.Mheshimiwa Spika, nawashukuru wanachama, viongozi wa ngazi mbali mbali na wapenzi wa Chama cha Demokrasia na Maendeleo (CHADEMA) popote pale walipo ndani na nje ya Tanzania kwa kutuunga mkono wakati wote wa harakati za kudai haki katika siku ngumu na za hatari zilizofuatia uchaguzi batili wa Meya wa Jiji la Arusha. Msimamo wao umeendelea kututia nguvu na ujasiri hata katika kipindi hiki ambacho kuna dalili za baadhi yetu kutetereka katika mapambano yetu ya kudai haki.

Mheshimiwa Spika, Mwanafalsafa maarufu wa Kiyahudi Elie Wiesel alisema, “there may be times when we are powerless to prevent injustice, but there must never be a time when we fail to protest.” Kwa Kiswahili, “kuna nyakati tunaweza kuwa wadhaifu katika kuzuia uovu na dhuluma, lakini kamwe isijetokea wakati ambapo tutashindwa kupinga uovu na dhuluma.” Pengine tulikuwa dhaifu kudhibiti hujuma na dhuluma tulizofanyiwa kwenye uchaguzi mkuu uliopita, lakini kamwe hatutakuwa tayari kuhujumiwa katika uchaguzi wowote ujao, ukiwemo wa Jimbo la Igunga.

HALI YA USALAMA NCHINI

Mheshimiwa Spika,
 dira ya Wizara ya Mambo ya Ndani ya Nchi ni kutoa huduma bora katika kudumisha amani, utulivu na umoja nchini. Katika kutekeleza dira hiyo, Wizara imeweka dhima ya kulinda usalama wa raia na mali zao, kuhifadhi wanaotuhumiwa kwa uhalifu na kuwarekebisha wafungwa, kudhibiti uingiaji na utokaji nchini wa raia na wageni, kutoa huduma za zimamoto na uokoaji na kuwahudumia wakimbizi waliopo nchini.

Mheshimiwa Spika, licha ya maneno mazuri ya dira na dhima hiyo, hali ya usalama wa raia na mali zao katika nchi yetu ni mbaya. Vile vile, mfumo mzima wa kimagereza umekuwa wa kutesa na kudhalilisha zaidi wafungwa na watuhumiwa wa uhalifu kuliko kuwahifadhi na kuwarekebisha; Mfumo wa uhamiaji umekuwa dhaifu kuruhusu wageni haramu badala ya kuwadhibiti; Na Kikosi cha Zimamoto na Uokoaji, kimekuwa cha kushuhudia matukio ya moto badala ya kuyazuia na kuyadhibiti!

Mheshimiwa Spika,Mpigania haki za watu weusi wa nchini Marekani, Hayati Dr. Martin Luther King, Jr. aliwahi kusema kwamba“peace is not the absence of war but merely the presence of Justice”, yaani “amani si hali ya kutokuwepo vita, bali ni uwepo wa haki”. Kwa kipimo hiki cha amani, nchi yetu haina amani kama viongozi wa serikali na wa Chama cha Mapinduzi (CCM) wanavyodai kila mara. Hii ni kwa sababu, licha ya ukweli kwamba Tanzania hakuna vita, pia ni dhahiri Tanzania sio nchi ya haki. Nathibitisha;

MAUAJI YA RAIA WASIO NA HATIA

Mheshimiwa Spika, 
wakati viongozi wa serikali yetu na wapambe wao wakidai majukwaani, na kwa sauti kubwa, kwamba Tanzania ni nchi ya amani na utulivu, serikali hiyo hiyo kwa kutumia Jeshi lake la Polisi na vyombo vingine vya usalama imekuwa mstari wa mbele kuua raia wasiokuwa na hatia wanapodai haki zao.

Mheshimiwa Spika, Serikali hii inayohubiri amani kila kukicha, kwa kutumia vyombo vyake vya mabavu, imekuwa inakamata wananchi wasiokuwa na hatia na kuwabambikizia kesi za uwongo pale wanaposhindwa kutoa rushwa katika vituo vya polisi na mahakamani. Watawala hawa, wanaopenda kujidai kwamba mamlaka yao imetoka kwa Mungu na kwa hiyo iheshimiwe, wamekuwa wanatesa wananchi wetu katika vituo vya polisi na magerezani kinyume na sheria za Tanzania na hata za kimataifa.

Mheshimiwa Spika, licha ya maovu yote haya wanayotendewa, Watanzania hawajachukua silaha kujitetea. Hata hivyo, ‘utulivu’ huu hauwezi kuitwa amani, maana amani si uwepo wa ukatili bali ni uwepo wa haki kama tafsiri sahihi ya Dr. Martin Luther King, Jr ilivyosema

Mheshimiwa Spika, Ripoti iliyotolewa na Kituo cha Sheria na Haki za Binadamu (LHRC), imeeleza kuwa katika kipindi cha mwaka 2010 peke yake, watu 52 walikufa wakiwa mikononi mwa Jeshi la Polisi na vyombo vingine vya usalama. Kati ya wote waliouawa, watu 10 waliuawa na Jeshi la Polisi katika maeneo ya Mgodi wa Dhahabu wa North Mara, Nyamongo wilayani Tarime peke yake.

Mheshimiwa Spika, kwa mujibu wa ripoti hiyo, katika kipindi cha miezi mitano ya mwanzo ya mwaka 2011, tayari Watanzania 21 wameuawa kwa kupigwa risasi katika maeneo mbalimbali ya nchi yetu na wengine wengi kuumizwa. Kati ya hao, watu 9 wameripotiwa kuuawa na Jeshi la Polisi katika maeneo yanayozunguka Mgodi wa Dhahabu wa North Mara peke yake. Vile vile, watu watatu waliuawa katika Jiji la Arusha wakati polisi walipovamia maandamano ya amani kupinga uchaguzi batili wa meya wa Jiji hilo.

Mheshimiwa Spika, cha kusikitisha zaidi, wilayani Tarime Watanzania walishuhudia Jeshi la Polisi likitumia giza la usiku kuiba maiti za marehemu lililowaua na baadae kuwatelekeza barabarani na kukimbia. Sasa tunadhihakiwa na watu wengine duniani kwa kuwa na Jeshi la Polisi linaloiba maiti badala ya kulinda uhai wa raia na mali zao!

Mheshimiwa Spika, mbali na ripoti kuhusu ukiukwaji mkubwa Haki za Binadamu, zilizotolewa na taasisi zisizo za kiserikali, taasisi za kiserikali kama vile Tume ya Haki za Binadamu na Utawala Bora ya Tanzania (CHRAGG) pia zimethibitisha jinsi vyombo vya dola vya nchi hii vilivyo katili. Taarifa ya Tume ya Haki za Binadamu na Utawala Bora ya mwaka 2002/03 iliyochapishwa mwezi Mei 2005, ilisema kwamba malalamiko mengi iliyoyapokea yalihusu polisi kubambikizia raia kesi, mahabusu kutopelekwa mahakamani kama taratibu zinavyotaka, watuhumiwa kupigwa na kuteswa wakati wa kuhojiwa na upelelezi hasa wa kesi za mauaji kuchukua muda mrefu

Mheshimiwa Spika, Ibara ya 14 ya Katiba ya Jamhuri ya Muungano wa Tanzania, 1977 inatoa haki ya kuishi kwa kila mtu na inaitaka Serikali kumpatia kila mtu hifadhi ya maisha yake. Vile vile, vifungu vya 195 na 196 vya Kanuni ya Adhabu, Sura ya 16 ya Sheria za Tanzania vinakataza vitendo vya mauaji vilivyo kinyume na sheria. Kwa mujibu wa ibara ya 30(2)(c) ya Katiba, mauaji yanaweza kuwa halali endapo yamefanywa kwa mujibu wa sheria iliyotungwa kwa ajili ya “... kuhakikisha utekelezaji wa hukumu au amri ya mahakama iliyotolewa katika shauri lolote la ... jinai.”

Mheshimiwa Spika, kwa maana hiyo, mauaji yanayofanyika ili kutekeleza adhabu ya kifo inayokuwa imetolewa na mahakama kwa kosa la mauaji chini ya kifungu cha 197 cha Kanuni ya Adhabu ni mauaji halali kwa mujibu wa sheria zetu. Kinyume kabisa cha sheria hiyo, mauaji yote ambayo yamekuwa yakifanywa na Jeshi la Polisi hayajawahi kutokana na adhabu yoyote ya kifo iliyotolewa na mahakama za Tanzania na kwa hiyo ni mauaji haramu.

Mheshimiwa Spika, kwa mujibu wa Sheria ya Uchunguzi wa Vifo, Sura ya 24 ya Sheria za Tanzania, kifo chochote ambacho kimetokea katika mazingira ya mashaka kinatakiwa kuchunguzwa kwa mujibu wa sheria hiyo. Hatua ya kwanza ya uchunguzi wa kifo cha aina hiyo, kwa mujibu wa sheria hiyo, ni uchunguzi wa kidaktari (autopsy) ili kubainisha sababu halisi ya kifo hicho. Aidha, hatua ya pili ni uchunguzi wa kimahakama – kwa kutumia mahakama ya korona – ili kujiridhisha kwamba kifo hicho hakijatokana na matendo au sababu za kijinai.

Mheshimiwa Spika, katika matukio yote ya mauaji yanayolihusisha Jeshi la Polisi na vyombo vingine vya usalama vya Tanzania, utaratibu huu wa kisheria haujawahi kufuatwa. Aidha, ukiachia matukio ya mauaji yaliyomhusisha aliyekuwa Afisa Upelelezi wa Jinai wa Mkoa wa Dar es Salaam, Abdallah Zombe na wenzake ambao hata hivyo waliachiwa huru, matukio mengine yote ya mauaji hayajawahi kuchunguzwa na wahusika kufikishwa mahakamani. Huu ni ushahidi tosha kuwa serikali yetu kupitia Jeshi la Polisi na vyombo vyake vingine vya usalama imekuwa ikiua wananchi wasio na hatia.

Mheshimiwa Spika,
 ni dhahiri kuwa ukiukwaji huu mkubwa wa haki za binadamu unafanyika kutekeleza sera isiyo rasmi ya Serikali ya Tanzania. Ndio maana, licha ya Katiba yetu kukataza vitendo hivyo, mauaji yanayofanywa kinyume cha sheria na vyombo vya dola pamoja na vitendo vingine vya ukiukaji wa haki za binadamu hayapungui badala yake yanaongezeka kila mwaka. Na ndio maana Serikali haijawahi kuchukua hatua yoyote kuhakikisha mauaji haya yanachunguzwa kwa mujibu wa Sheria ya Uchunguzi wa Vifo na wala kuhakikisha wahusika wa mauaji haya wanachukuliwa hatua za kisheria au za kinidhamu pamoja na vitendo vingine vya ukiukaji wa haki za binadamu. Uthibitisho mkubwa zaidi,

Mheshimiwa Spika, ni kwamba Serikali ya Tanzania haijawahi kuleta kwenye Bunge hili tukufu Mkataba wa Kimataifa Dhidi ya Utesaji na Matendo au Adhabu Nyingine za Kinyama, Zinazotweza na Kudhalilisha wa mwaka 1984 (the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, 1984) uliopitishwa na Azimio la Baraza Kuu la Umoja wa Mataifa Na. 39/49 la tarehe 10 Desemba 1984 na kuanza kutumika mwaka 1987.

Mheshimiwa Spika,
 Serikali inayoruhusu vyombo vyake vya usalama kufanya mauaji kinyume na sheria dhidi ya raia wasiokuwa na hatia; Serikali inayoruhusu vyombo vyake vya usalama kutesa raia wake kwa namna za kinyama kama zinazoelezwa katika taarifa za taasisi za haki za binadamu; Serikali ya aina hiyo inapoteza uhalali wake machoni mwa wananchi wake na mbele ya macho ya dunia.


Mheshimiwa Spika,
 katika hali hiyo, wananchi wanakuwa na haki ya kupinga udhalimu na ukandamizaji huo. Uhamasishaji wa upinzani dhidi ya serikali ya aina hiyo unakuwa ni wajibu wa kila mzalendo wa kweli. Kama alivyosema Frederick Douglass zaidi ya miaka 150 iliyopita, “he is a lover of his country who rebukes rather justify its sins”, yaani, “mpenzi wa nchi ni yule anayekemea madhambi ya nchi yake, badala ya kuyahalalisha”! 
Mheshimiwa Spika, Kambi Rasmi ya Upinzani Bungeni inaitaka Serikali itoe kauli rasmi kwa nini matukio yote ya mauaji ya raia yaliyo kinyume na sheria hayajawahi kuchunguzwa kwa mujibu wa Sheria ya Uchunguzi wa Vifo; Na kwa nini hakuna hata mhusika mmoja ambaye amewahi kuchukuliwa hatua za kisheria au za kinidhamu kwa kuhusika kwao na mauaji haya.

Mheshimiwa Spika, pia Kambi Rasmi ya Upinzani Bungeni inaitaka Serikali iwaeleze Watanzania kwa nini inakwepa kuridhia Mkataba wa Kimataifa Dhidi ya Utesaji na Matendo au Adhabu Nyingine za Kinyama, Zinazotweza na Kudhalilisha kwa karibu miaka thelathini tangu Mkataba huo upitishwe na Baraza Kuu la Umoja wa Mataifa na karibu robo karne tangu uanze kutumika!

Mheshimiwa Spika, mifano hiyo michache inaonyesha kuwa nchi hii haina amani ya kweli. Kilichopo si amani, bali utulivu unaojengwa na nidhamu ya woga. Kambi rasmi ya Upinzani bungeni inatahadhirisha kuwa utulivu wa nchi hii upo hatarini kutoweka kabisa kwa sababu kuu mbili; Kwanza, ni kuongezeka kwa matabaka baina ya Watanzania wengi walio maskini na wasiotendewa haki, na tabaka la Watanzaniawachache matajiri na wawekezaji wanaopata zaidi haki kwa sababu ya uwezo wao wa kifedha. Iwapo hatua stahiki hazitachukuliwa, basi dalili zipo wazi kuwa uvumilivu wa Watanzania wengi maskini sasa umefika mwisho na lolote linaweza kutokea.

Mheshimiwa Spika, pili, amani ya nchi hii ipo hatarini kutoweka kabisa kwa sababu ya mtazamo potofu wa serikali yetu wa kuamini kuwa njia sahihi ya kudumisha amani ni kutumia Kikosi cha Kutuliza Ghasia (FFU) kuwafyatulia wananchi risasi, mabomu ya machozi na kuwapiga kwa virungu. Hata hivyo, sasa wananchi wameanza kuzoea hali hiyo na ni dalili mbaya kwa utawala. Ni lazima serikali ikaelewa kuwa umma wa Watanzania milioni 40 kamwe hauwezi kusambaratishwa kwa risasi za Jeshi la Polisi, ambao idadi yao ni takribani 50,000.

Mheshimiwa Spika, ukweli kwamba majeshi ya nchi yoyote duniani hayawezi kushindana na haki, ukweli na utu unaopiganiwa na nguvu ya umma, tayari umeshadhihirika sehemu mbalimbali duniani, kabla na baada ya uhuru wa nchi hii. Mfano mzuri ni nchi ya Afrika Kusini, Msumbiji, Kenya, Uganda, Namibia, Zimbabwe, na Sudan ya Kusini, ambayo imepata uhuru hivi karibuni. Aidha, hivi karibuni wananchi waliochoka kunyanyaswa katika nchi za Misri, Tunisia, Yemen, Bahrain, Libya na hivi sasa jirani zetu wa karibu kabisa Malawi, wameanza na bado wanaendelea na vuguvugu la kudai haki zao bila kuhofia majeshi na silaha nzito za kivita.

Mheshimiwa Spika, Serikali yoyote inayopuuza haki na utu, na kufikiri kwamba kuongeza idadi na vifaa vya kijeshi ndiyo suluhisho la amani na utulivu, ni serkali yenye viongozi waliopotoka. Kambi rasmi ya Upinzani kwa niaba ya mamilioni ya Watanzania, inachukua fursa hii kuionya serikali hii inayoongozwa na CCM, kwamba amani ya nchi hii kamwe haiwezi kulindwa na FFU wala majeshi, bali italindwa kwa kuhakikisha haki inatendeka na utu wa Mtanzania unaheshimiwa, tena bila kuwepo kwa matabaka ya kinyonyaji dhidi ya Watanzania wengi maskini.

Mheshimiwa Spika, Mheshimiwa Waziri Mkuu wakati anahitimisha mjadala kuhusu bajeti ya Ofisi yake, alikubaliana na ushauri wa Kambi rasmi ya Upinzani, na kuahidi kwamba serikali itaanzisha 
mahakama ya kuchunguza mauaji hayo, yaani “Coroner’s Court”, kwa mujibu wa Sheria ya Uchunguzi wa Vifo, (The Inquest Act) Sura ya 24 ya Sheria zetu.

Mheshimiwa Spika, Kambi rasmi ya Upinzani inachotaka sasa ni kuona utekelezaji; Je, ni lini Waziri mwenye dhamana atatangazauteuzi wa kuundwa kwa mahakama hiyo katika Gazeti la Serikali, ili wauaji wahukumiwe? Tunataka uchunguzi ufanyike haraka ili haki iwe itendeke mapema.

Mheshimiwa Spika, Kambi rasmi ya Upinzani inasisitiza kuwa mbali na kuwabaini polisi waliohusika na mauaji hayo, pia uchunguzi huo uhakikishe serikali inatekeleza yafuatayo;
  1. Ilipe Fidia stahili kwa mujibu wa sheria husika za nchi kwa ndugu na/au jamaa wa wale wote waliouawa kutokana na vitendo vya Jeshi la Polisi la Tanzania na kwa wale wote walioumizwa kwa namna yoyote ile na/au kuharibiwa mali zao kutokana na vitendo hivyo;
  2. Iwachukulie hatua kali za kinidhamu na kisheria askari Polisi wote, wakiwemo askari Magereza na wale wa Wanyamapori ambao wamehusika katika mauaji haya tuliyoyabainisha katika hotuba hii na kwenye hotuba iliyotolewa na Kiongozi Mkuu wa Kambi rasmi ya Upinzani, Mhe. Freeman Mbowe; Vinginevyo, hali hii ikiachwa iendelee kama ilivyo sasa ni hatari kwa usalama wa Watanzania.
AJALI ZA BARABARANI

Mheshimiwa Spika, mbali na mauaji yanayofanywa na Jeshi la Polisi, pia Watanzania wengi wamekuwa wakipoteza maisha na kupata vilema vya maisha, kwa sababu ya kukithiri kwa ajali za barabarani. Taarifa tulizonazo zinaonyesha kuwa ajali za barabarani ziliongezeka kutoka 22,019 mwaka 2009 hadi 24,926 mwaka 2010.

Mheshimiwa Spika, katika ajali hizo watu 3,689 walifariki na wengine 22,064 walijeruhiwa. Kiasi hiki ni kikubwa sana kwani ni sawa na ajali 68 kwa kila siku. Hii ni sawa na kusema Watanzania 10 hufariki kila siku kutokana na ajali za barabarani ambazo nyingi zinasababishwa na uzembe na rushwa, baina ya wadau wa barabara na Jeshi la Polisi kitengo cha barabara (Traffic).Mathalan, ukaguzi wa magari siku hizi umekuwa ukilenga zaidi kuuza stika za nenda kwa usalama, badala ya kukagua hali halisi magari. Ni aibu kwa serikali kubakia kutuma salamu za rambi rambi vifo vya ajali vinapotokea, badala ya kuchukua hatua kali za kudhibiti uzembe.

Mheshimiwa Spika, vifo vitokanavyo na ajali vimekuwa vingi zaidi kutokana na kuongezeka kwa ajali za pikipiki. Kwa mfano, kwa mwaka 2009 ajali za pikipiki zilikuwa 3,406 , mwaka 2010 ajali hizi zilikuwa 4,363 na jumla ya watu waliokufa kutokana na ajali hizi mwaka 2010 ni 657 kutoka vifo 385 vilivyotokea mwaka 2009.Hii ni kwa mujibu wa ripoti ya Kituo cha Sheria na Haki za Binadamu ya mwaka 2010, ukurasa wa 63. Kambi rasmi ya Upinzani tunataka kujua serikali ina mkakati gani wa kukabiliana na wimbi hili la vifo vya vijana wetu kutokana na ajali hizi za pikipiki.



Mheshimiwa Spika, 
Kambi rasmi ya Upinzani pia inapendekeza Askari Polisi wa Usalama Barabarani waanze kupewa mafunzo maalum ya kutoa Huduma ya Kwanza, ili ajali za barabarani zinapotokea, kazi yao isiwe ni kupima nani kasababisha ajali, bali pia wawe na uelewa wa kutoa huduma za dharura za kuokoa na kusaidia majeruhi.

RUSHWA NDANI YA VYOMBO VYA USALAMA

Mheshimiwa Spika,
 Jeshi la Polisi linanuka rushwa likilinganishwa na taasisi nyingine za serikali. Ripoti ya kiwango cha rushwa katika nchi za Jumuiya ya Afrika Mashariki “East Africa Bribery Index 2010” inaonyesha kuwa jeshi la polisi limeshika namba moja kwa rushwa hapa nchini kwa mwaka 2010 kwa kupata asilimia 65.1 kati ya taasisi nyingine za umma hapa nchini.

Mheshimiwa Spika, Rushwa hii imekuwa ikiwaumiza sana wananchi wa kawaida ambao wamekuwa wakikosa huduma na hasa kwa kuwa hawana fedha za kuwahonga maafisa wa polisi. Hali hii imepelekea hata baadhi ya wananchi kubambikiwa kesi mbalimbali kwa makusudi kwasababu tu wanakuwa hawana fedha za hongo kwa polisi na hata wengine wamekuwa wakijichukulia sheria mkononi kwa kujua jeshi la polisi haliwezi kuwatendea haki. Hivi sasa kuna msemo maarufu, “kuingia kituo cha polisi ni bure, ila kutoka ni pochi”. Hii ni aibu kubwa kwa Jeshi la Polisi na Serikali. Badala ya kuwa Jeshi la kulinda usalama wa raia na mali zao, sasa vituo vya polisi vimekuwa ni pango la kufanyia biashara ya rushwa na hongo.

Mheshimiwa Spika, rushwa pia imekithiri ndani ya vitengo vyote vya Wizara ya Mambo ya Ndani kama vile Idara ya Magereza, Kikosi cha Zimamoto, na Polisi Usalama Barabarani (Traffic). Kibaya ni kuwa rushwa hii ni ya kitaasisi, kwani hata raia wema wanapopenda kutoa taarifa kuhusiana na kuombwa rushwa hujikuta wakiwa kwenye wakati mgumu zaidi badala ya kupatiwa msaada.

Mheshimiwa Spika, Kambi rasmi ya Upinzani Bungeni inaamini kuwa vipato vidogo, maslahi duni na maisha ya umaskini ya askari wetu wakiwemo wale wa Idara ya Magereza, vinachangia kwa kiasi kikubwa cha rushwa ndani ya Jeshi la Polisi. Pia, ukiukwaji mkubwa wa utawala wa sheria na maadili ya jeshi polisi ndio vinavyosababisha kushamiri matendo maovu na usaliti wa kweli, haki na utu ndani ya vikosi vya Jeshi la Polisi na idara zake zote.

Mheshimiwa Spika, kwa hiyo, Kambi rasmi ya Upinzani, inaitaka serikali na Bunge lako tukufu kuhakikisha maslahi ya walinzi hawa wa usalama wa raia na mali zao, yanaboreshwa kwa kiwango cha kuwafanya waone kwamba raslimali wanazolinda na raia wanaowalinda, wanathamini mchango na wajibu wao. Kwa kuzingatia umuhimu wa majeshi yetu ya Usalama wa Raia, Kambi rasmi ya Upinzani inataka mishahara ya askari wetu ipandishwe ili waweze kumudu gharama zote za msingi za kimaisha.

Mheshimiwa Spika, njia nyingine ni kuhakikisha utawala wa sheria ndani ya Jeshi la Polisi unaheshimiwa kikamilifuBadala ya kuwahamisha vituo polisi wanaotuhumiwa na makosa mbalimbali ikiwemo kujihusisha na vitendo vya rushwa, Kambi rasmi ya Upinzani, inasisitiza kuwa ni lazima utawala wa sheria uheshimiwe kikamilifu. Yeyote anayebainika kujihusisha na rushwa achukuliwe hatua kali za kinidhamu na kisheria, ili kukomesha uhalifu huu.

Mheshimiwa Spika, Kambi rasmi ya Upinzani inawataka Askari polisi wote wa nchi hii, wasikubali kutumiwa vibaya kukandamiza demokrasia na haki za wananchi, kwa maslahi ya kukibeba chama fulani cha siasa na badala yake watende haki kwa manufaa ya Watanzania wenzao. Wajue kuwa Watanzania wanaowafyatulia risasi, mabomu ya machozi na kuwapiga virungu, ni Watanzania wenzao. Ni sawa na Baba zao, Mama zao, Kaka zao au wadogo zao, kwa hiyo wasikubali kutumika vibaya kuua au kukandamiza ndugu zao. Badala ya kufanya hivyo, tunawashauri waishinikize serikali hii inayowatumia vibaya, iboreshe mishahara na maslahi yao.

Mheshimiwa Spika, Askari mmoja mwenye hekima wa nchini Ujerumani, wakati wa utawala wa Dikteta Adolf Hitler, aliwahi kusema, “Nilifarijika pale nilipofukuzwa kazi kwa kutokutii amri dhalimu inayokiuka haki na utu wa mwanadamu.... kwa sababu nilijua siku moja nitakufa na nitakuwa na wajibu mbele ya Mwenyezi Mungu. Nilikataa kuheshimu amri katili za wakuu wangu kazini, kwani Mwenyezi Mungu ni mkubwa kuliko wao”. Kambi rasmi ya Upinzani, inawasihi polisi wote nchini wasikubali tena maagizo yote katili ya makamanda wao.

Mheshimiwa Spika, ili kuondoa malalamiko mbalimbali kuhusu ajira za polisi na maslahi yao mengine, Kambi rasmi ya Upinzani, inashauri serikali kufanya yafuatayo;i) Kuondoa utaratibu wa Askari polisi kuthibitishwa ajira yake baada ya kipindi cha miaka 12 ya sasa, na kuhakikisha ajira ya polisi inathibitishwa angalau ndani ya miaka 3.ii) Askari polisi wapandishwe vyeo kutokana na utumishi wao jeshini na vigezo viwe vya wazi, ili kuondoa malalamiko ya upendeleo.iii) Viwepo vigezo vya wazi katika kuwapanga Askari wetu kwenye vitengo mbalimbali, kwani hili linalalamikiwa sana kuwa sasa baadhi ya vitengo ni kwa ajili ya kundi fulani, huku wengine wakiwa wao ni kukaa vitengo hivyo hivyo mpaka wastaafu.iv) Ngazi za kupanda mishahara ziwe kama kwa watumishi wengine wa umma badala ya polisi wao kuwa na utaratibu wa kupanda vyeo. Pawe na vigezo ambavyo Askari akivifikia basi hata kama hajapanda cheo, basi ngazi yake ya mshahara nayo iongezeke.

Mheshimiwa Spika, hii itasaidia kuhakikisha kuwa Askari waliokaa muda mrefu wanakuwa na mishahara iliyoboreka na hata wakistaafu wanaweza kupata pensheni nzuri na hivyo kuweza kukabiliana na ukali wa maisha pindi wanapostaafu.

Mheshimiwa Spika, ili kuboresha zaidi utendaji wa Jeshi la Polisi na kuwatendea haki askari wetu, Kambi rasmi ya Upinzani inapendekeza kuwa utaratibu wa sasa wa polisi wa ngazi za chini kukatwa shilingi 5,000 kila mwezi kwenye mishahara yao, kwa ajili kugharamia mazishi yao na wategemezi wao, ufutwe mara moja, kwani hilo si jukumu lao, ni jukumu la serikali. Kambi rasmi ya Upinzani tunatoa msimamo wa kuitaka serikali ihakikishe inawarudishia askari polisi fedha zote ilizowakata kila mwezi kwa ajili ya mazishi, kwani haikuwa halali kufanyiwa hivyo.


Mheshimiwa Spika, 
Kambi rasmi ya Upinzani inasisitiza, iwapo serikali haitawarudishia askari polisi pesa zao zote ilizowakata kila mwezi kwa madai ya kugharamia mazishi yao pindi wanapofariki, na iwapo utaratibu huu utaendelea; Kambi rasmi ya Upinzani inatangaza rasmi kwamba tutapanua ajenda yetu ya maandamano na kufanya pia maandamano nchi nzima ya kushinikiza pesa zote walizokatwa askari polisi warudishiwe na utaratibu huo ukome.

JESHI LA MAGEREZA

Mheshimiwa Spika,
 Mwezi Mei mwaka 2010, Chama cha wanasheria wa Tanganyika (Tanganyika Law Society) walichapisha ripoti ya matokeo ya ukaguzi katika Magereza waliyoifanya katika magereza 24 mwaka 2009. Ripoti hiyo inaeleza kuwa wafungwa walifanyiwa ukatili na kuteswa wakati wakiwa mahabusu, na pia kulikuwa na msongamano mkubwa katika magereza ya Dar es Salaam, Tabora, Arusha, Mara, Mwanza, na Tanga.

Mheshimiwa Spika, taarifa hiyo pia ilidokeza kuwa katika gereza la Segerea kulikuwa na wafungwa 170 katika vyumba vya jela ambavyo vilijengwa kwa ajili ya watu 50, na katika Gereza la Ilagala mkoani Kigoma, wafungwa walilazimika kutembea zaidi ya maili 4 kwenda kuchota maji kwa sababu ya matatizo ya usafiri. Ripoti ilielezea kushindwa kwa gereza kuwapatia wafungwa huduma ya msingi ya usafi pamoja na chakula cha kutosha.


Mheshimiwa Spika,
 katika ripoti yake ya nusu-mwaka (2010), Kituo cha Sheria na Haki za Binadamu, kimeeleza kuwa Idara ya Magereza imetumia takriban shilingi 650 kwa siku kwa ajili ya chakula kwa wafungwa, badala ya shilingi 2,420 ambayo ilikuwa imeidhinishwa na serikali. Kwa mantiki hiyo, uhaba wa chakula magerezani hautokani na uhaba wa fedha, bali unasababishwa na ufisadi wa fedha za chakula zinazoidhinishwa na Bunge hili. Kiasi kinachoidhinishwa sicho kinachotumika, fedha nyingi inabanwa na kuingia kwenye mifuko ya watu wachache. 
Mheshimiwa Spika, serikali isiyojali wafungwa ni serikali katili. Kambi rasmi ya Upinzani haiko tayari kuvumilia ufisadi na ukatili huu unaofanywa dhidi ya wanadamu wafungwa. Tunataka kujua; Je, mpaka sasa ni Watumishi wangapi wachechukuliwa hatua ndani ya Wizara ya Mambo ya Ndani, Jeshi la Polisi na ndani ya Idara ya Magereza, kwa kufanya mchezo huu mchafu wa kutafuna fedha za chakula cha wafungwa? Pia, tunataka kujua serikali imejizatiti vipi kuhakikisha hali hii haijirudii tena.

MRADI WA VITAMBULISHO VYA TAIFA

Mheshimiwa Spika, kwa mujibu wa Mpango wa Maendeleo wa Miaka Mitano, uamuzi wa kuwa na vitambulisho vya taifa ulifikiwa kwa mara ya kwanza mwaka 1968, katika kikao cha Kamati ya Usalama cha Wakuu wa nchi za Afrika Mashariki na Kati, kilichohusisha Kenya, Uganda, Zambia na Tanzania. Kwa mantiki hiyo, imepita takribani miaka 43, tangu nchi hii iamue kuwa na vitambulisho vya taifa lakini hadi leo bado havijaanza kutolewa.

Mheshimiwa Spika, hakuna lugha yoyote nzuri ya kuuzungumzia ucheleweja huu isipokuwa kusema tu, serikali yetu imefanya uzembe na haina dhamira ya dhati ya kuhakikisha Watanzania wanapata vitambulisho vya taifa mapema.P
ia ni vema ikazingatiwa kuwaMradi hu umechukua muda wa mwaka mmoja tangu tarehe ambayo Bodi ya Zabuni ya Wizara ilitoa idhini kwa ajili ya kazi ya ushauri na kusainiwa kwa mkataba wenyewe. Ucheleweshwaji wote huu, una athari katika kufikia na kutimiza malengo ya shughuli za mradi.

Mheshimiwa Spika, Kambi rasmi ya Upinzani inashauri kwamba menejimenti ya Mamlaka ya Vitambulisho vya Taifa iongeze juhudi katika kuongeza kasi ya Mradi wa Vitambulisho vya Taifa kwa manufaa ya Taifa, angalau viwe tayari ifikapo mwaka 2014, ili pamoja na mambo mengine, Tume Huru ya Uchaguzi itakayoundwa, iangalie uwezekano wa kuvitumia kuboresha Daftari la Kudumu la Wapiga Kura, ambalo katika uchaguzi mkuu uliopita lilionekana kuwa na dosari kubwa. 


IDARA YA ZIMA MOTO NA UOKOAJI

Mheshimiwa Spika, 
Idara ya zima moto ni muhimu sana kwa usalama wa raia na mali zao, pindi majanga mbalimbali yanapotokea. Hata hivyo, taarifa ya Mdhibiti na Mkaguzi wa Hesabu za Serikali katika ukurasa wa 82, inathibitisha serikali haina sera ya usimamizi wa vihatarishi na namna ya kuvidhibiti. Kambi rasmi ya Upinzani inahoji, serikali inawezaje kunusuru maisha ya wananchi dhidi ya majanga kwa ufanisi, ikiwa hata sera yenyewe haipo?Kambi rasmi ya Upinzani inataka hatua za haraka zichukuliwe kuhakikisha vikosi hivi ambavyo vipo kwa ajili ya kusaidia jamii vinakuwepo katika kila sehemu ya nchi ili kushughulikia majanga mbalimbali yanayotokea wakati wa dharura kwa ufanisi.

Mheshimiwa Spika, wakati hakuna ufanisi wa kutosha katika kudhibiti na kushughulikia majanga, ripoti ya Mdhibiti naMkaguzi na Mkuu wa serikali, imegundua upotevu mkubwa wa fedha za umma, kiasi cha shilingi 1,441,689,620 ambazo hazina maelezo ya kutosheleza na hivyo kusababisha hasara. Kambi ya upinzani tunaitaka serikali kuimarisha idara hii na pia kuwachukulia hatua waliohusika na ufisadi huu.

IDARA YA UHAMIAJI

Mheshimiwa Spika,
 kumekuwa na ongezeko la wageni wengi kutoka nchi za nje na limekuwa jambo la kawaida, kiasi cha kujiuliza kama nchi hii ina utaratibu wowote wa kuratibu na kudhibiti uingiaji wa wageni hapa nchini. Imeripotiwa hata kwenye vyombo vya habari kuwa Mkoani Morogoro, katika kipindi cha Desemba 2009 hadi Februari 2010, raia wa Somalia 80 wanaoishi nchini kinyume cha sheria walikamatwa na Idara ya Uhamiaji.

Mheshimiwa Spika, kukamatwa kwa wageni hao ni uthibitisho wa namna tatizo la wahamiaji haramu lilivyo sugu na kubwa, kwani hao ni idadi ndogo tu kulingana na watu wanaoingia nchini bila kufuata taratibu za uhamiaji, na kuishia mitaani wakiishi na kufanya shughuli zao kama vile ni raia nchi hii. Mbali ya raia hao wa Somalia, pia wamo raia wa nchi zingine zikiwemo Jamhuri ya Kidemokrasi ya Congo, Burundi, Rwanda, Kenya, Uganda, Pakistan, Nigeria na China, India, Bangladesh, ambao wanaishi Tanzania kwa mfumo usio rasmi, bila ya kuwa na hati zinazowaruhusu kufanya hivyo.

Mheshimiwa Spika, utaratibu wa kuachia kila mgeni kuingia Tanzania na kuishi atakavyo bila ya vyombo husika kujua kuwepo kwake, kiusalama ni hatari, hasa katika zama hizi za kusambaa kwa tatizo la ugaidi na uharamia wa kimataifa katika masuala ya fedha, biashara za binadamu na hata ulaghai na utapeli. Kambi rasmi ya Upinzani inasisitiza hoja yake ya kutaka mchakato wa kupata vitambulisho vya taifa uharakishwe, kwani pia vitasaidia kuwabaini kwa urahisi wageni ambao wataingia nchini bila kuzingatia taratibu zilizopo.

WAKIMBIZI

Mheshimiwa Spika, 
kwa muda mrefu yameripotiwa matukio yanayotishia usalama wa raia wetu pamoja na mali zao hasa maeneo yenye wakimbizi. Kambi ya upinzani tunaitaka serikali kutoa taarifa ya kina juu ya usalama wa mipaka yetu na watu wake katika maeneo hayo.Pia serikali itupe taarifa kuhusu makambi yaliyofungwa, Je, yatatumika kufanyia shughuli gani baada ya kambi hizo kufungwa?

MAPENDEKEZO YA JUMLA YA KAMBI RASMI YA UPINZANI.

Mheshimiwa Spika, Kambi rasmi ya Upinzani,
 tunapenda kutoa mapendekezo yafuatayo ili kuweza kuliboresha Jeshi la Polisi, Magereza na Uhamiaji na kuyafanya yawe ya kisasa zaidi na kuweza kukabiliana na changamoto mbalimbali na za kisasa ambazo zimetokea na zinaendelea kutokea.Tunapendekeza mambo yafuatayo yaweze kufanywa kikamilifu;

(i) Ijengwe maabara ya kitaifa ya masuala ya Uhalifu (National Crime Laboratory). Hii itasaidia kupata vipimo vya kubaini uhalifu na hivyo itarahisishia kazi jeshi la polisi katika kuchunguza na kupambana na uhalifu.

(ii) Vyuo vya polisi vya Moshi, Dar Es Salaam na vile vya Magereza kama vya Ukonga na Tukuyu viimarishwe ili kuhakikisha maofisa wanaohitimu kwenye vyuo hivi wanakuwa na weledi wa kutosha katika kupambana na uhalifu unaotumia mbinu mpya na za kisasa.

(iii) Kikosi cha Uokoaji kiboreshwe kwa kupatiwa nyenzo na vifaa vya kisasa, ili kiweza kukabiliana vizuri na majanga.

(iv) Sheria ya Uhamiaji irekebishwe ili kuhakikisha kuwa Mamlaka za Mikoa zinakuwa na uwezo wa kutoa hati za kusafiria (Passport). Hati hizo ziwe zinapatikana kwa haraka mara baada ya maombi badala ya hali ilivyo sasa ambapo huchukua muda mrefu hadi mtu kupata Passport.

(v) Zitengwe fedha za kutosha kwa ajili ya kununulia fulana za kuzuia risasi (bullet proof vest), ili Askari polisi wote nchini waweze kukabiliana vizuri na uhalifu mkubwa hasa ujambazi wa kutumia silaha.

Mheshimiwa Spika, kwa ujumla, Kambi rasmi ya Upinzani inasisitiza kwamba ukandamizaji na ukiukwaji wa utu na haki za binadamu, hautavumiliwa kamwe. Na ieleweke kwamba, tishio la Usalama na Amani ya Nchi hii si Maandamano ya Amani yanayofanywa na CHADEMA, kupinga uovu, bali ni ukiukwaji wa haki na utu wa Mtanzania, unaofanywa na serikali ya Chama cha Mapinduzi (CCM).

MAPENZI: Mwanamke, ULIPENDEWA NINI?

Katika makala iliyopita, nilijaribu kuelezea tabia moja ya wanaume katika mahusiano ambayo hujitokeza mara nyingi, na wakati mwingine, pande zinazohusika zinakuwa hazielewi ni kwa nini hali kama hiyo huweza kutokea na namna ya kuchukuliana nayo pale inapokuwa imejitokeza.

Kabla sijaendelea pia, napenda kuelezea kuwa makala hizi zinalenga zaidi kutoa “sauti ya wanaume” katika masuala ya mahusiano. By “sauti ya wanaume” simaanishi kwamba mimi ndimi msemaji wa wanaume, bali najaribu kuelezea masuala mbalimbali ya wanaume katika mahusiano, ambayo mara nyingi huwa hayafahamiki au kueleweka vizuri kutokana na sababu mbalimbali.

Katika makala ya leo, nitajikita zaidi katika kujadili KIINI CHA KUPENDWA katika kuimarisha na kudumisha mahusiano. Kwanza kabisa, ni muhimu kufahamu kuwa kila palipo na mapenzi/mahusiano ya kimapenzi kati ya watu wawili huwa kunakuwa na sababu iliyowaleta pamoja hao watu hadi wakaingia katika hayo mahusiano. Kwa upande wa wanaume, baadhi ya sababu za kumpenda na kumchagua msichana huwa ni pamoja na Uzuri wa Sura, Umbile la Mwili, Saizi ya Mwili (mnene/mwembamba), rangi ya ngozi, kimo, upeo wa ufahamu, elimu, dini, kabila n.k. n.k.

Makala hii hailengi katika kuangalia msingi/uhalali wa ‘vigezo’ hivyo kwa undani, bali umuhimu wa ‘vigezo’ hivyo katika kuyadumisha na kuyaendeleza mapenzi hayo.

Kwako mwanamnke unayependwa na mwanamne, moja ya mambo ya muhimu sana kwako kuyaelewa ni sababu ya huyo mwanamme kukupenda wewe. Ni muhimu sana kuelewa ni kitu gani kilichomfanya akawavuka wasichana wengine wote aliokutana nao maishani mwake tangu akiwa mtoto hadi akaamua kukuchagua wewe. Umuhimu wa kuelewa sababu hizo unatokana na umuhimu wa vigezo hivyo katika kuendeleza au kukatisha uhusiano wenu huko mbeleni.

Namna za Kuweza kufahamu

Kuna njia nyingi ambazo unaweza kuzitumia kuweza kuupata ukweli kutoka kwa mwenzako kuhusu sababu za yeye kukupenda. Hakuna njia ambayo ni ya uhakika kuweza kukupatia majibu kamili na unayoyahitaji, hivyo ni muhimu kufaham na kutumia njia mbalimbali. Baadhi ya njia hizo zinaweza kuwa ni kumuuliza moja kwa moja alikupendea nini, wewe kutumia muda kujifunza yeye anapenda nini kwako, kujifunza yeye anapenda nini kwa ujumla na uone kama inahusiana na wewe. Wakati mwingine unaweza kujua yeye anakupendea nini kwa kusikiliza na kuelewa ni vitu gani huwa hawapendei wengine. e.g. Unaweza kumsikia akisema maneno kama: "huwa sipendagi wasichana/wanawake wenye...", hapo unaweza kuelewa jambo...

Kwa bahati mbayai, kwa baadhi ya wanaume, huwa sio rahisi kupata majibu ya swali hilo kwa urahisi, kwa sababu zao nyingi ambazo hutofautiana – SIO WANAUME WOTE WATAKUAMBIA KIRAHISI TU NI KWA NINI ANAKUPENDA WEWE NA SI WENGINE!!!

Kuchumbiwa/Kuolewa Sio Mwisho

Sehemu na ya pili na ya muhimu sana kwako mwanamke, ni kuelewa namna utajitunza na kutunza kile alichokupendea mwenzako. Tambua kwamba, MNAPOKUBALIANA KUWA KATIKA UHUSIANO (uchumba au ndoa) SIO MWISHO WA MCHAKATO WA MAPENZI BALI NDIO MWANZO. Kwa hiyo ni lazima uelewe ni mambo yatakayoendeleza ari na hamasa ya mapenzi miongoni mwenu baada ya hapo. 

Kwa bahati mbaya, Wanawake wengi wanapoingia katika mahusiano, HUSUSAN AKISHAOLEWA huwa anaona kama vile ndio mwisho wa “mchakato wa mapenzi.” Matokeo yake wengi huwa hawajali tena wala kufuatilia ni kitu gani kilimfikisha katika uhusiano! Wengi hujiachia na kujiona ndio 'ameshafika', kumbe safari ndo imeanza!!

Ni lazima uelewe ukipendwa wewe sio kwamba ndio mwisho wa kupenda kwa huyo mwanamme wako, inaweza kuwa AMEAMUA kuacha kupenda tena (na kuishia kwako); LAKINI haimaanishi HANA UWEZO wa kupenda tena! Jifunze na uelewe ni namna gani uamuzi wake wa kupenda unaweza kuishia kwako, na asipate mawazo mengine tena ya kuendelea kupenda “kwingine” akiwa na wewe tayari!

Ni jambo la muhimu sana kuelewa kwamba huyo mwanamme hakukupenda kwa sababu tu wewe ni mwanadamu, amewaona na kuwaacha wanadamu wengi sana kabla yako lakini akakuchagua wewe. Hivyo ni muhimu sana uelewe kilichokutofautisha wewe na hao wengine ni nini, ili uelewe namna gani utaendelea kuwa tofauti na hao wengine siku zote!

Mifano

Kwa bahati nzuri/mbaya sababu za wanaume kuwapenda wanawake ndizo huwa ziko wazi zaidi kuliko kinyume chake. Kwa sababu hiyo tutaangazia baadhi ya sababu ambazo wanaume huzitumia kumchagua mwanamke wa kuishi naye, na namna gani mwanamke akikubali kupendwa anakuwa na wajibu kwa upande wa “kuzitunza” hizo sababu ili huyu mwanmme aendelee kuwa na sababu za kuendelea kumpenda huyu mwanamke.

Baadhi ya vigezo ambavyo wanaume huvitumia katika kuchagua mke ni Uzuri wa Sura, Tabia, Umbile la Mwili, Saizi ya Mwili (mnene/mwembamba), rangi ya ngozi, kimo, upeo wa ufahamu, elimu, dini, kabila n.k. n.k. (kumbuka si lengo la mkala hii kujadili uhalali wa hivi kuwa vigezo vya kumchagulia mtu, hilo huwa ni suala binafsi la mchaguaji). Hapa tutaangalia zaidi nafasi ya vigezo hivi katika kuendeleza uhusiano.

Wanawake wengi sana huwa hawapendi kuambiwa kuwa amependewa saizi ya mwili wake (unene/wembamba) kwa sababu wengi huwa na hofu siku zote kwamba kuna siku anaweza akakonda/akanenepa hivyo mapenzi yakapungua/yakaisha! Hata hivyo, hata kama una hofu, bado hiyo inaweza kuwa ni sababu ya yeyey kukupenda. Kwa mfano, kuna wanaume ambao hata siku moja huwa haoni uzuri wowote wa kumvutia kwa mwanamke mwembamba (kama ma-miss na ma-model) na wengine ni kinyume chake! yote haya ni mapendeleo ya watu binafsi.

Kutunza Kiini cha Mapenzi

Kwa mfano, ukibaini kwamba mume wako alikupenda kwa sababu ya saizi ya mwili wako, inaweza kuwa ni wembamba au unene, ni muhimu sana ukajitahidi kwa kadri ya uwezo wako kutunza umbo lile alilolipenda. Nimependa kuchagua huu mfano kwa sababu ndio huwa unaonekana kuwa mgumu zaidi kwa wanawake walio wengi na hivyo wengi huwa hawapendi kukubali hiki kuwa ni kigezo cha kupendwa!  Wengi husikika wakisema, "akinipendea wembamba je nikinenepa?" USIWE NA HOFU, jambo la muhimu sana hapa kuelewa ni ile jitihada uliyo nayo au utakayoionesha ya “kujitunza” hata kama matokeo yatakuwa tofauti.

Changamoto ya kutunza maumbo ya miili ni kubwa zaidi kwa wakina mama wa mijini ambao maisha wanayoishi (lifestyle) huwa yanahamasisha miili kunenepa, hata kwa vyakula vichache sana (tofauti na wale wa maeneo ya vijijini). Jitahidi kumuonesha mwenzako kwa maneno na vitendo kwamba unapenda ku-maintain umbo alilokupendea, hata kama matokeo yanakuwa tofauti. Unaweza ukaonesha hivyo kwa uchaguzi makini wa vyakula unavyokula, kutokula ovyo-ovyo na kila kitu kianchopita mbele yako, ufanyaji wa mazoezi n.k. Kitu cha muhimu hapa ni kuonesha kwamba unapenda kuwa vile anavyopenda, ila ni kitu kilicho nje ya uwezo.

Kinamama wengi kwa bahati mbaya ‘wakishapendwa’ hujibweteka kwa kuamini kuwa hataniacha, tayari ni wangu, nimefunga naye ndoa kanisani, nina cheti cha ndoa, tayari nina watoto naye, yeye ni kiongozi (e.g wa kanisa au serikali hivyo atakwepa aibu ya kushindwa ndoa yake) n.k. Na kwa bahati mbaya zaidi, ni wanaume wachache sana watakaokuja na kukwambia mke wangu jitunze “hivi-na-vile” ili niendelee kukupenda. Mumeo anatarajia ulishafundishwa hivyo siku nyingi, na mama yako, shangazi zako na kwenye kicheni-pati chako! Hii pia inachangiwa na tabia ya wanaume kutokupendela kuongelea maswala binafsi ya watu, ikiwa ni pamoja na ya kwao wenyewe au watu wao wa karibu!

Kama alikupenda kwa sababu ya Ukimya na Utaratibu wako, jitahidi sana baada ya kuingia katika mahusiano, hususan ndoa, usianze kuwa ‘mapepe’ ETI kwa sababu ‘tayari’ ameshakuweka ndani. Tunza ile amana aliyokupendea ili pendo lake kwako liendelee kudumu.

Kama alikupenda kwa sababu ya upeo wako wa ufahamu aliouona kwako, jitahidi hata utakapo ‘ingia ndani’ usibweteke tu na kuwa ‘mama wa nyumbani’. Endelea kujinoa na kujifua kwenye eneo lako la “strength” ili uendelee kuwa strong ndani yake pia.

Ni muhimu sana kufahamu kwamba wakati mwingine hauwezi kuwa na sifa zote za mwanamke ambaye mumeo anampenda, LAKINI unaweza ukazitunza na kuziboresha zile chache ulizo nazo ili kuhakikisha kuwa unaendelea kuwa ‘tofauti’ na wanawake wengine machoni pa mwenzi wako.

KUMBUKA SIKU ZOTE, kile alichokupendea zaidi mumeo ndicho kinachokutofautisha zaidi na wanawake wengine wote waliobaki, sio pete ya uchumba wala cheti cha ndoa kinachokutofautisha nao KIMAPENZI kwake. Cheti na pete vinaweza kukutofautisha nao kwake KISHERIA lakini mapenzi ni hisia, hayabadilishwi au kushikiliwa na cheti au pete…

Tunza vizuri amana aliyokupendea mwenzio, utaendelea kuwa juu siku zote moyoni mwake! Usijibweteke na kujiamini kwa sababu tayari ‘unaye’, kumbuka haujushika moyo wake! Kama hauamini, ukweli ni kwamba ANAWEZA ASIKUACHE (kwa sababu za kisheria au kijamii), LAKINI AKAISHI NA WEWE AKIWA HAKUPENDI TENA KAMA MWANZO…. Maumivu zaidi yatakuwa kwako...

MAPENZI: Wanaume na “Window-Shopping”!

Maisha ya mahusiano ya kimapenzi katika ya wanaume na wanawake huwa yanahusisha mambo mengi sana, mazuri kwa mabaya, yenye kuleta furaha na kuleta huzuni, yeye kujenga na kuvunja moyo na labda mengine ambayo huweza kuwa linajitokeza zaidi ni yenye kuleta maudhi.

Moja ya mambo ambayo huumiza sana wapenzi, na kuleta maudhi sana katikanafsi, ni kuwa na mpenzi wako halafu ukaona au kubaini wakati fulani katika mahusiano yenu kwamba anakuwa interested na mtu mwingine tofauti na wewe.

Mara nyingi sana katika mahusiano ya kimapenzi, wanawake ndio huwa waathirika wakubwa wa matatizo na miendendo isiyo mizuri katika mahusiano. Hii inatokana na sababu nyingi, ambazo sio sehemu ya makala yangu ya leo. Leo, napenda nijadili tatizo moja ambalo huwaumiza wanawake katika mahusiano, nalo ni tatizo la Window-Shopping za waume/wapenzi wao wa kiume.

Katika muktadha huu, window-shopping ni ile tabia ya mwanamme kuwa na mke/mchumba wake lakini bado akaonekana kuwa interested kwa namna moja au nyingine na wasichana/wanawake wengine. Kitendo hiki mara nyingi sana huwaumiza wanawake kwa kuwa mwanamke huanza kuhisi kwamba labda hapendwi, labda ana upungufu, labda anazidiwa mvuto na wengine, labda anaelekea kuachwa, labda mwenziwe amebadilika, labda… labda….. labda…..

Pamoja na sura nyingi zinazoweza kuwa zimejificha katika tabia hii, ambazo baadhi yake zinaweza kuwa hizo zilizokwenye hizo ‘labda’ hapo juu, Napenda kuwasaida kukuelekeza katika upande mwingine wa tabia hiyo miongoni mwa wanaume, ambao unaweza kuwa hauna madhara, au kama unayo, basi yakawa ni madogo sana, iwapo utaelewa. Swali la msingi unalopaswa kujiuliza na kulijibu katika hali kama hiyo ni: ALIKUPENDEA NINI?

Ni muhimu kufahamu kwamba mwanamme anapoamua kumchagua binti kuwa mpenzi/mchumba/mke wake, kwa kawaida huangalia vigezo vingi sana, na akisha vijumlisha hutafuta wastani. Ule wastani atakaoupata ndio humpatia jibu – AKUCHUAGUE WEWE AU ATAFUTE MWINGINE! Hii huwa ni kanuni ya msingi sana kwa mwanamme yeyote aliye-serious na mahusiano. Wanaume ambao humchagua mtu kwa kuangalia sifa moja tu huwa wanakuwa na uwezekano mkubwa wa kubadilisha mawazo wakati wowote kuliko wale wanaochagua kwa vigezo vilivyotafutwa kwa wastani.

Wastani wa tabia huweza, kwa mfano, kujumuisha vitu kama sura, tabia, umbo la mwili, kimo, dini, rangi ya ngozi, kabila/uraia, uongeaji/ukimya, ucheshi/u-seriousness n.k. n.k. n.k. Kweli ni kwamba katika hali ya kawaida, ni vigumu ukawa na sifa zote hizo, au basi ni vigumu kuwa na sifa zote anazozitaka huyo anayekutaka wewe.

Lakini kwa kutumia kanuni ya wastani, mwanamme anaweza akaridhika na wewe na akakutwaa wewe na kuwaacha wengine.
